This User Agreement (“Agreement”) is a legal contract between you ("User", "you", or "your") and Emich Technology (M) Sdn Bhd (“Company”, "we", "us", or "our"), governing your use of the SoloCar platform located at https://www.solocar.my (the “Website”).

By accessing or using the Website, you agree to comply with and be bound by this Agreement. If you do not agree, you must not use the Website.

1. Nature of the Platform

SoloCar is a listing platform for vehicles. We facilitate contact between buyers and sellers, but we do not own, inspect, endorse, or guarantee any vehicles or transactions made through the platform.

2. User Responsibilities

As a user of SoloCar, you agree to:

Provide accurate and truthful information at all times.
Only list vehicles you legally own or are authorized to sell.
Not use the platform for fraudulent, illegal, or misleading activities.
Ensure that all communication and transactions comply with Malaysian law.

3. Account Registration

You may be required to register an account to list or contact sellers. You agree to:

Keep your login credentials confidential.
Not allow others to access your account.
Be responsible for any activity under your account.

We reserve the right to suspend or terminate accounts at our discretion.

4. Listings

When posting a vehicle listing, you must:

Provide detailed, honest, and accurate information.
Ensure that all uploaded photos belong to you or are used with permission.
Remove the listing once the vehicle is sold or no longer available.

We may review, modify, or remove any listing that violates our terms or policies.

5. Payments & Fees

Some features (e.g., premium listings) may incur fees. You agree that:

All fees are clearly stated and payable in advance.
Payments are processed through third-party gateways.
Fees are non-refundable unless stated otherwise in our Refund Policy.

6. Prohibited Activities

You agree not to:

Post fake or duplicate listings.
Impersonate another person or entity.
Use bots, scrapers, or automated tools.
Upload malicious content or spam.
Violate any third-party rights or applicable laws.

7. Disputes Between Users

SoloCar is not a party to any transaction between users. We are not liable for:

Payment disputes
Delivery or inspection issues
Vehicle condition or legal ownership

Users are encouraged to conduct due diligence before entering into any transaction.

8. Intellectual Property

All content on the platform, including logos, text, design, and software, is owned by Emich Technology (M) Sdn Bhd or its licensors. You may not copy, reproduce, or distribute content without written permission.

9. Privacy

Your use of the platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

10. Termination

We may suspend or permanently terminate your account at any time if:

You violate this Agreement;
You engage in fraudulent or harmful activity;
You misuse the platform in any way.

We reserve the right to take legal action where necessary.

11. Disclaimers

We do not guarantee the accuracy, safety, or legality of any listing or transaction.
We are not responsible for users’ actions on or off the platform.
The platform is provided "as is" without any warranties.

12. Limitation of Liability

To the fullest extent permitted by law, Emich Technology (M) Sdn Bhd will not be liable for any damages, losses, or claims arising out of your use of the platform or any transaction made through it.

13. Governing Law

This Agreement is governed by the laws of Malaysia. Any disputes will be resolved in the courts of Malaysia.

14. Amendments

We reserve the right to modify this Agreement at any time. Updates will be posted on this page. Continued use of the platform constitutes your acceptance of any revised terms.
